The United Nations watched as man began to race into
outer space during the
late 60's. From these events the Outer Space Treaty of 1967 was inacted.
It simply put in place guidelines which every country, government,
non - governmental entities would follow while exploring outer space. The
Outer Space Treaty also made sure no one government would rule over outer
space, instead all governments would, like a Federation.
Article VI of the Outer Space Treaty reads -
"State Parties to the Treaty Shall bear international responsibility
for national activities in outer space, including the Moon and other celestial
bodies, whether such activities are carried on by governmental agencies
or by non- governmental entities, and for assuring that national activities
are carried out in conformity with the provisions set forth in the present
Treaty. The activities of non-governmental enities in outer space, including
the Moon and other celestial bodies, shall require authorization and continuing
supervision by the appropriate State Party to the Treaty. When activities
are in outer space, including the Moon and other celestial bodies, by an
international organization, responsibility for compliance with this Treaty
shall be borne both by the international organization and by the States
Parties to the Treaty participating in such organization."
Simply put, we must submit a proposal to the United Nations, Secretary General
for review and wait for there approval before building on the Moon.
We submitted our proposals as of March 5, 1998.
Then in 1979, the United Nations put forth the Moon Treaty,
which was excepted into to UN Law in 1984. The Moon Treaty was written to
make sure no one person, government, company, or corporation could own the
Moon, or any celestial bodies. Only the structures which they, themselves
build in space or on celestial bodies.
The Moon Treaty of 1979 Article 11, Point 3 states
"Neither the surface, nor the subsurface of the moon, no any part there
of or natural resources in place, shall become property of any State, international,
intergovernmental, or non-governmental organization, national organization,
or non-governmental entity or of any natural person. The placement of personnel,
space vehicles, equipment, facilities, stations, and installations on or below
the surface or subsurface, shall not create a right of ownership over the
surface or the subsurface of the moon or any areas thereof."
According to this point, no person or government can own the surface or subsurface
of the Moon. Only what you build can be called yours.
There has been much debate in regards to the Moon Treaty whether it is U.N.
law. The United States and Russia never signed this treaty, so there are those
who say they can lay legal claim to the Moon and all other eight planets and
there planets as well. Even if the Moon Treaty is not law. The authors of
the Outer Space Treaty, which was signed by every country, states in its first
opening paragraph
The Outer Space Treaty of 1967 Article I
"Outer Space, including the moon and other celestial bodies, shall be
FREE for exploration and use by all states without
discrimination of any kind on a basis of equality and in accordance with the
international law, there shall be FREE access to all areas of celestial bodies."
Then how can anyone person, government, state, etc lay claim to ownership
of the Moon or other celestial bodies. It would no longer be free for all
to enjoy. But by building a structure on the surface on the Moon, is like
homesteading in the early days of the United States.
Noone owns the Moon, just like homes that sit on the beach
in Southern California, you own the home not the land or sand it sits on,
